Privacy Policy

1. Our Promise

Your memories, your instructions, and your trust are sacred. Eterna Legacy was created to safeguard what matters most—personal messages, wishes, and designations meant for the right people, at the right time. We never sell your information, never share it without consent, and never use your data for advertising.

Our role is simple: to help ensure your digital legacy is protected and delivered according to your intentions.

2. What We Collect

  • Identity & Contact Information (e.g., name, email, phone).
  • Designated Contacts you choose to include.
  • Activity Records & Cadence (timestamps, confirmations, alive-check responses, basic status logs).
  • Optional Vault Data you voluntarily store or upload within your vault.

We do not collect financial account numbers, banking credentials, or unrelated browsing data.

3. How We Protect It

All information is stored in encrypted environments using industry-standard protocols. Access is restricted to authorized systems under automated, monitored conditions. Human access is not part of normal operations.

We maintain redundant backups, strict access controls, and audit trails designed to detect misuse or anomalies. While no system can be perfectly secure, our goal is to meet or exceed the security practices used by modern SaaS applications.

4. Alive-Check & Notification Logic

Eterna Legacy periodically pings you with an “alive-check” on the cadence you choose. If you confirm in time, nothing else happens. If you miss several check-ins and any configured grace windows, the system may:

  • Mark your account as “unresponsive” for internal logic.
  • Trigger notifications to your designated trusted contacts.
  • Begin delivering the messages and designations you pre-approved.

These actions are automated based on rules you set. They do not constitute legal determinations about life, death, or capacity.

5. Analytics & System Learning

To keep the system reliable and investor-grade, we monitor non-personal, aggregated metrics such as:

  • Alive-check response rates and timing (in aggregate).
  • Plan adoption (e.g., Free, Guardian, Infinity tiers).
  • High-level feature usage.
  • Delivery success rates and system performance.

These analytics are de-identified and never include message content, contact names, personal email addresses, or phone numbers. We use them to improve uptime, scale infrastructure, and inform product decisions—not to profile individuals or sell data.

6. No Fiduciary or Insurance Role

Eterna Legacy does not act as a fiduciary, executor, trustee, attorney, or insurer. We do not manage money, provide legal or financial advice, or guarantee any particular outcome. Our role is to automate secure communication based on the rules you configure.

7. Your Choices & Rights

You can:

  • Request a copy of the personal data we hold about you.
  • Update or correct information at any time inside your account.
  • Request deletion, subject to any legal or safety obligations to retain certain records.

8. International Use & Jurisdiction

The Service is operated from the United States. By using Eterna Legacy, you understand that your data may be processed in the U.S. and other locations with equivalent safeguards. Our primary legal jurisdiction is the State of New York.

9. Changes to This Policy

We may update this Privacy Policy as the product evolves. When we make material changes, we will update the “Last Updated” date and, where appropriate, provide additional notice through the Service or email.

Terms of Service

1. Acceptance of Terms

By accessing or using Eterna Legacy (“the Service”), you agree to these Terms and our Privacy Policy. If you do not agree, you must discontinue use. These Terms form a binding agreement between you and Ellite International, the parent operator of Eterna Legacy.

2. Purpose of the Service

Eterna Legacy is a digital legacy and notification platform. It allows you to create encrypted messages, set notification rules, designate contacts, and trigger delivery based on inactivity checks and grace windows. It is not a will, trust, insurance product, or legal service.

3. User Responsibilities

  • Provide accurate, up-to-date information.
  • Maintain access to your registered email (and phone, if used for SMS).
  • Keep your login credentials secure.
  • Refrain from uploading unlawful, harmful, or abusive content.
  • Comply with all applicable laws in your jurisdiction.

4. No Fiduciary, Legal, or Insurance Relationship

Using Eterna Legacy does not create a fiduciary, attorney-client, or insurance relationship. We do not advise on estate planning, tax, or law. You are responsible for consulting appropriate professionals for those areas.

5. Data, Security & Analytics

We take reasonable measures to secure your data and maintain service reliability, as described in our Privacy Policy. We may use aggregated, anonymized analytics to improve the platform, but we do not sell or rent personally identifiable information.

You acknowledge that no system is perfectly secure and agree to use the Service at your own risk. Eterna Legacy cannot be held liable for breaches or disruptions caused by events outside our reasonable control.

6. Third-Party Services

The Service may rely on third-party infrastructure providers (for hosting, email delivery, SMS, etc.). By using Eterna Legacy, you consent to this operational use. While we carefully choose partners, we are not responsible for outages or issues that originate solely from those third-party systems.

7. Intellectual Property

All non-user content on the Service—branding, design, layouts, code, documentation—is the intellectual property of Ellite International or its licensors. You retain ownership of content you upload but grant us a limited license to store, encrypt, process, and deliver it as part of the Service.

8. Limitation of Liability

To the fullest extent permitted by law, Eterna Legacy and its affiliates are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or interruption of business.

Where liability cannot be fully excluded, our total aggregate liability for any claim arising from or relating to the Service will not exceed the greater of: (a) the amount you paid for the Service in the twelve (12) months preceding the event, or (b) one hundred U.S. dollars (USD $100).

9. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms, threaten platform integrity, or use the Service in a fraudulent or abusive way. Upon termination, we will handle your data in accordance with our Privacy Policy.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any disputes arising out of or relating to the Service shall be brought exclusively in the state or federal courts located in New York County, New York.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and may provide additional notice via the Service or email. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
