Terms of Service
By accessing or using Eterna Legacy (the “Service”), you agree to these Terms. If you do not agree, you must discontinue use of the Service. These Terms form a binding agreement between you and Ellite International, the parent operator of Eterna Legacy.
1. What Eterna Legacy is (and is not)
Eterna Legacy is a digital legacy and notification platform. It allows you to create encrypted messages, upload documents, set continuity rules, and notify designated contacts when inactivity checks and grace windows indicate something may be wrong.
Eterna Legacy is not a will, trust, insurance policy, investment product, or legal service. We do not provide legal, tax, medical, or investment advice.
2. Your responsibilities
- Provide accurate, up-to-date registration information.
- Maintain access to your registered email (and phone, if SMS or future alerts are enabled).
- Keep your login credentials confidential and secure.
- Use the Service only for lawful purposes and do not upload harmful, abusive, or infringing content.
- Comply with all applicable laws in your jurisdiction when using Eterna Legacy.
3. Continuity checks & notifications
Our system runs “alive-check” emails and other continuity signals according to the cadence you configure. If you do not respond within your selected grace windows, Eterna Legacy may escalate to your designated contacts and, over time, release messages or instructions as you have configured.
You are responsible for choosing appropriate contacts and for ensuring that the rules you configure reflect your intentions.
4. Payment & tiers
Certain features (including Infinity and future paid add-ons) are available only on paid tiers. Pricing, features, and promotions may change over time. Where we offer free trials, we will clearly state when billing begins and how you can cancel.
5. Third-party services
Eterna Legacy uses trusted third-party providers for infrastructure such as cloud storage, authentication, analytics, and payment processing (for example, Stripe). These providers process data on our behalf under appropriate agreements, but they do not own your content.
6. Limitation of liability
To the maximum extent permitted by law, Eterna Legacy and Ellite International are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including delays, delivery failures, or loss of data. Our aggregate liability for any claim will not exceed the amount you have paid us for the Service in the preceding twelve months.
7. Changes & governing law
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you by email or in-product notice. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of New York, excluding its conflict of law principles. Any disputes will be resolved in the state or federal courts located in New York, New York.
